We also collect non-identifiable data (such as browser type and device type) and aggregate data sets that show us group-level data and trends about our users and guests. This information does not contain any individual-level data and cannot be used to identify you.

How We Collect Your Personal Information

The personal information we collect is obtained directly from you -- either online, by phone, or in person. We also collect personal information automatically through your use of our Website as well as through our third-party service providers.

Information Collected through Automated Means:

Nevada Privacy Rights

Nevada residents have the right to submit a verified request directing us not to sell their personal information. If you are a Nevada resident, and would like to submit such a request, please send your request to futek@futek.com.

Your California Privacy Rights

If you are a California resident, you have certain privacy rights under the California Consumer Privacy Act ("CCPA") regarding your personal information. However, these rights are not absolute, and, in certain cases, we may decline your request as permitted by law.

Information: You can request the following information about how we have collected and used your personal information during the past 12 months:

  • The categories of sources from which we collected personal information.

Only you, or a person you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. We will need to confirm your identity and California residency to process your requests to exercise your information, access, or deletion rights. We cannot process your request if you do not provide us with sufficient detail to allow us to verify your identity and understand and respond to the request.

You may only make two requests over a 12-month period. FUTEK will respond to your request within 45 days of receiving the request and will provide information from the 12-month period prior to your request. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

FUTEK's Right to Deny your Request

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to: complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you; detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities; debug products to identify and repair errors that impair existing intended functionality; exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided by law; enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us; comply with a legal obligation, exercise or defend legal claims; or make other internal and lawful uses that information that are compatible with the context in which you provided it.

Rights for Individuals Within the European Economic Area

FUTEK is a global brand and thus may conduct business with individuals from within the European Economic Area (EEA). In order to carry out business with our customers within the EEA, FUTEK processes the personal information of individuals residing within the EEA pursuant to the provisions set forth above in this Privacy Policy.

FUTEK collects its users' personal information who reside within the EEA who access FUTEK's Website for the following reasons:

  • Where it is pursuant to your consent;
  • Where it is necessary for the performance of the contract between you and FUTEK;

  • Where it is necessary for our legitimate interests;
